The European Commission proposed a regulation on a common framework for media services in the internal market (European Media Freedom Act, EMFA) on 16 September 2022 with the aim of introducing common rules in the EU on media pluralism and the independence of media services, i.e. TV, video-on demand, radio, press and podcasts.
Cullen International’s new report examines the relationship between the proposed EMFA and the EU’s Audiovisual Media Services Directive (AVMSD) that harmonises certain minimum rules for audiovisual media services (TV broadcasts and on-demand services) and video-sharing platforms.
Our analysis sheds light on the overlaps between the substantive areas covered by both initiatives and explores the articulation between the provisions, in particular on:
- Information requirements for providers of news and current affairs
- Powers and resources of national regulatory authorities
- Cooperation between national regulatory authorities
- Right of users to customise a media offer; and
- National measures effecting the operation of media services.
