Cullen International has just published an update of the benchmark tracking the progress in transposition of the EU Audiovisual Media Service Directive across 14 countries.

Since the last report:

• France completed the transposition of the directive with the adoption of five decrees. Rules include revised investment obligations for TV channels and new rules on commercial communications on video-sharing platforms.
• In Italy, the legislative decree implementing the directive entered into force on 25 December 2021. The higher investment quotas for VOD services (including non-domestic) in favour of EU independent works, and the cross-border application of existing investment obligations for TV channels, are applicable from 1 March 2022.

Belgium, Croatia, Denmark, Germany, Finland, the Netherlands, Poland, Sweden and the UK have also transposed the directive. The UK was bound to implement the directive since the transposition deadline fell before the end of the Brexit transition period (end of 2020).

As for other countries:

• Spain and Ireland sent their draft laws to parliament, where approval is expected in spring 2022;
• Norway delayed again a public consultation. Parliament could start examining a draft law in autumn 2022 at the earliest.
