Large online platforms that act as gatekeepers between businesses and consumers benefit from significant network effects. They control specific ecosystems that new competitors may find difficult to replicate.
Further, according to the European Commission, users are increasingly exposed to illegal content, products, services and activities, while there is also a need to protect their fundamental rights.
The Digital Markets Act (DMA) and Digital Services Act (DSA) complement each other to regulate digital platforms in Europe.
To help navigate the evolving enforcement landscape, Cullen International is launching two new tools: the DMA Database and DSA Database.
These databases provide searchable, comprehensive case summaries detailing decisions by the European Commission and the Court of Justice of the EU (CJEU) when they related to the DSA and the DMA, including all relevant procedural steps.
The DMA Database tracks and analyses cases on gatekeeper designation, non-compliance, and other DMA-related matters.
It also contains links to Cullen International’s summaries of competition cases where the European Commission or national competition authorities addressed the same or similar practices ex post.
The DSA Database covers intermediary services that have been designated as very large online platforms and search engines. It compiles (per service):
- all the EU Commission’s infringement cases (and appeals);
- all designation decisions (and appeals, including regarding the payment of supervisory fees);
- a repository of oversight-related information for each designated service, which includes links to the latest transparency and risk assessment reports that providers need to publish on a regular basis.
Both tools feature intuitive interfaces, powerful filters, and concise case analyses — all updated as new developments occur. Together, they provide essential intelligence for anyone tracking the European Commission’s implementation of these landmark acts.
The DMA Database is available to our EU Digital Economy Service subscribers, and the DSA Database to our EU Media Service subscribers.
