Private copying levies offer creators remuneration for acts of copying that cannot be effectively licensed or monitored. Levies are justified when national laws include an exception to the creator’s exclusive right of reproduction in the case of acts of copying done by individuals for private non-commercial use.
Cullen International's new research shows whether a private copying exception has been adopted and, if a levy applies, the categories of copies included when calculating compensation, the products subject to levies, the calculation method and levy amounts.
Most of the countries covered in the region provide a private copying exception. Argentina and Chile foresee the exception exclusively in case of software and there is no levy related to the exception.
The report also shows that Canada, Peru and the USA are the only studied countries that have implemented a remuneration system, while in Mexico there is a bill under discussion on this matter.
