Cullen International will host a free online regulatory briefing where representatives from the European Commission and the European Data Protection Board (EDPB) will present recent and forthcoming initiatives on transfers of personal data outside the EU. The briefing will take place on 17 March 2022.
This event has passedOne of the main objectives of the General Data Protection Regulation (GDPR) is to allow the free flow of personal data between EU countries. However, companies can transfer personal data outside the EU only under conditions provided by the GDPR. Transfers can be allowed:
- based on a Commission adequacy decision which recognises the destination country has an “essentially equivalent” level of data protection (e.g. EU-South Korea or EU-UK adequacy decisions);
- in the absence of an adequacy decision, the company transferring the personal data has to implement “appropriate safeguards” for the data transfers (e.g. by using standard contractual clauses); or
- exceptionally, only if specific derogations apply (e.g. when the individual has given their consent, having been informed of the possible risks of the transfer).
Cullen International has invited Alisa Vekeman, policy officer at the international data flows and protection unit of the European Commission DG Justice, and Ignacio Gómez Navarro, legal officer at the Secretariat of the European Data Protection Board (EDPB), to present:
- the recently adopted adequacy decisions by the European Commission;
- the state of play of the negotiations between the EU and the US on the privacy shield successor; and
- the recent EDPB recommendations and guidelines on the notion of data transfers.
This free online regulatory briefing will also touch upon the upcoming standard contractual clauses expected to be published by the European Commission in the first quarter of 2022, plans of the Commission to enlarge the list of adequacy decisions and available tools and instruments that can be used by companies when transferring data to third countries.
